Presentations by Kristopher M. Kline, PLS

Kristopher_M_Kline_PLSKristopher Kline is President of 2Point, Inc., became licensed in North Carolina in 1991 and is a 1999 graduate of the North Carolina Society of Surveyors (NCSS) Institute. Kris served for 3 years as Chairman of the NCSS Education Committee. His present business focuses exclusively on boundary and easement disputes. In 2003, Kris began offering continuing education courses in North Carolina on legal aspects of retracement. Since 2010, his teaching career has expanded to include conferences and seminars nationwide. Kris has presented several keynote addresses for state conventions. In 2020, Kris and his wife, Robyn, assumed administration of Surveyors Educational Seminars, a continuing education  program originally developed by Dr. Ben Buckner, and later operated by Donald A. Wilson and his wife Christine. Kris has published five books, with another in its final stages. Most recently, Kline is the author of the second edition of the Washington State Common Law of Surveys and Property Boundaries, available from the Land Surveyors Association of Washington (LSAW.) He is the author of over 80 technical articles. Written for a national audience and generally focused on various legal aspects of boundary retracement, most are now available on his blog at www.2point.net.

Burial grounds create numerous challenges for surveyors and other land use professionals, including determination of the underlying title/estate, relevant state and federal statutes, and access considerations for the descendants.

9:30 – 10:00 am BREAK with EXHIBITORS

1:00 – 2:30 pm  Power, Water and Sewer: Understanding Utility Easements | Kristopher M. Kline, PLS, 2Point, Inc.
This course focuses on easements “in gross” associated with municipal and regional utilities. Topics include exclusive vs. non-exclusive rights; overburden and “piggybacking” of additional easements within an existing easement; apportionment of exclusive rights; discovery rule for underground utilities.

8:00 – 9:30 am Deeds and Descriptions: Do’s, Don’t, and Depends | Kristopher M. Kline, PLS, 2Point, Inc.
The class considers elements of a deed, reservations and exceptions; reference to a plat. In addition, it covers rules of construction, calls for adjoiners, the critical link between monuments and deeds along with and key words and phrases for various types of descriptions. The course provides guidelines for providing concise descriptions without introducing ambiguities or unnecessary complexity. The course considers various types of deeds, including boundary descriptions, deeds of easement and riparian boundaries.

1:00 – 2:30 pm  Prescriptive Easements Like You’ve Never Seen Them | Kristopher M. Kline, PLS, 2Point, Inc.
While the basic concepts behind prescriptive easements are widely recognized, many developments in this area of the law are fairly recent. The course begins with the development of the Lost Grant Theory and its relationship to prescriptive rights in the United States. The various elements required for the creation of a prescriptive easement are discussed in detail. Tacking and claims by (and against) the state are considered, along with the scope & location of the resulting easement. This class also goes into court rulings for prescriptive easements associated with: Parking Areas; Subterranean and Visible Utility Easements; Light and Air; Trees and Shrubbery.

Registration Information

The registration fee is $275 for MSPS Members or $425 for Non-Members. A rate of $175 is available for non-licensed technicians (MSPS Associate Members), registration fee plus 2024 Associate Membership is $210. The deadline for registration is April 15, 2024. After this date, a 10% processing fee will be added to all registrations. The registration fee includes instructional materials, refreshment breaks, lunch on both days, cocktail reception with exhibitors and two breakfasts for registered attendees only. Complete the registration form and mail form and payment to MSPS, 722 E. Capitol Avenue, Jefferson City, MO 65101.

Location and Lodging

The Lodge of Four Seasons, 315 Four Seasons Drive, Lake Ozark is the location for the 2024 Spring Workshop. A block of rooms has been reserved in the main lodge at a rate of $137.00 for single or double occupancy. The deadline for hotel reservations is April 10, 2024. Golf Tournament

The MSPS PAC Fundraiser Golf Tournament will be held on Wednesday, May 1, 2024, at 1:00 pm at The Cove Golf Course and is $85 per person. Two mulligans per person are included and prizes are given for first, second and third placed teams, along with prizes for long drive, closest to the pin and longest putt!

Continuing Education

This course has been approved for 15 PDUs (7.5 each day) with the Missouri Board for Architects, Professional Engineers, Professional Land Surveyors and Landscape Architects.

Cancellation Policy

MSPS reserves the right to cancel the program and return all fees in the event of insufficient registrations. NO REFUNDS will be made AFTER April 15, 2024. A $25 processing fee will be applied to all refunds.
